Hello there,

I will be applying for ILR in February along with my Mrs.

I have completed 5 years in Tier 2 General Visa in June 2019 and she will be completing her 5 years on March 3rd 2020 as she entered UK on the same day 5 years ago.

I would like to make an application for both of us, rather making different applications now and in February. What I would like to know is, "What is the eligible date for my Mrs for her ILR application?"

From the blogs that I read and based on the information available in the Home office site, it says 28 days but I'm not sure if this is for Tier 2 PBS applicant or the same date is applicable for Tier 2 PBS Dependent?

Date of issue minus 28 days for both pbs main applicant and pbs dependant.

Thanks for the reply. So is it "Date of Issue!" - 28 and not "Date of Entry" -28? Is that right?

Yes. Date of ISSUE Minus 28 days


Date of ENTRY is used for NON PBS spouse visa applications. A different route altogether.

For PBS Main Applicant:
First entry must be taken within 180 days of visa issue to qualify for against ISSUE date.
If entered on or after 181 days than date of entry will be considered for calculation.
In both cases applicants may apply 28 days before each qualifying period.
AND before visa expiry.

For PBS dependant:
Absence limits only apply for visas issued from or after 11/01/2018.
