Spouse Settlement (ILR)

Hi,
I am Planning to apply spouse settlement (ILR) visa for my wife, she is going to complete 5 years ( spuse dependent) visa. she has stayed out of UK nearly 2.5 year due to some maternity need. can anyone please suggest me whether she is eligible for applying ILR or do we need to go another extension. ?

There is no absence limit for spouse visa holders.
As long as the spouse held the pertinent visa while out she has a chance of getting ILR.

Although spouse visa has no absence threshold but heavier absence makes weakened the cohabitation evidences needed for extension/ILR. 2.5 years of absence is indeed heavier.

It’s difficult to prove the cohabitation status with 2.5 years absence but it could be possible sometime.
