ILR eligibility - 5 years continuous residence with combination of PBS Dependant and Tier 2 General Visa

Hi,

I came to UK in Apr, 2015 on PBS Dependent Visa (My Spouse had Tier 2 ICT Long Term Visa). I am continuously living in UK since Apr, 2015. I got the Job in UK and got the Tier 2 General Visa in Apr, 2019. As per Tier 2 General Visa rules, I would be eligible for ILR after 5 years of continuous residence.

To summarize :
Apr, 2015 to Apr, 2018 - 4 years - PBS Dependent
Apr, 2019 to Apr, 2020 - 1 year - Tier 2 General Visa

I would be completing total of 5 (4+1) years continuous residence in Apr, 2020.

Please suggest, if I would be eligible for ILR in Apr, 2020 ?

No you are not eligible for ILR. You cannot combine PBS Dependent and main tier 2 time to make up 5 years.

When you switched to your own Tier 2, your ILR clock reset to zero and you have to wait 5 years on Tier 2 General before you can apply for ILR.
