Application Date for ILR

Hello,

I have gone through this website but require further information on when I can apply for my ILR. Here is my situation.

Date of Issue of Biometric Residence Permit (printed on BRP card): 18/12/2015
Date of Visa on passport eligible to enter the UK : 01/01/2016
Entry into the UK: 01/01/2016
Expiry of Residence Permit: 01/12/2020

I am in the UK on a tier 2 visa (5 year visa) but have been issued only for 4 years and 11 months from the date of visa issue to residence permit expiry. Would I need to apply for a work visa extension prior to applying for an ILR or is the 5 year residence period calculated from the date of issue of the biometrics card?

No need to get an extension. You can apply within 28 days from completing your 5 years, counting from initial visa issue date

Thanks Zimba for your response.

The thing is if I calculate 5 years from when I was issued a visa (01/01/2016), my 5 year stay in the UK will be completed on 01/01/2021. Counting back 28 days from 5 year completion date will bring it to 04/12/2020. But my residence permit expires on 01/12/2020. Does this then mean I have to apply for an work visa extension?

Could you please confirm?

Your visa date issue is the date on the BRP in this instance which is 18/12/2015. Your were granted a visa on 18/12/2015 (BRP issued with this date) and then given a sticker later for entry to the UK. As a visa sticker cannot be backdated, the date on the sticker is the date it was affixed to your passport and NOT your actual visa issue date
