ILR REFUSED PLEASE ADVICE

1. Married my wife 4th August 2011
2. She came under my in 2013
3. Entered UK on 27th December 2009 to 31st August 2011 (Student Visa)
4. 11th September 2011 to 16th September Post Sturdy Visa
5. 9th September 2013 – November 29th 2015 Tier 2 Minister of Religion Dependent
6. Nov 7th 2015 ILR refused Application refused (We thought the 2year dependent still work but the Las changed in 2012)
7. 15th December 2015 to 20th June 2018 dependant on ILR (Partner)
8. 1st June 2018 to 12th February 2021
9. We apply for ILR for her and was refused saying she has only used 47month out of 60month
10. This was counted from when she cross over to my ILR as dependent forgotten she was my dependent since 2013
11. She was offered 30month extension of family life route for her to use 10year route which we don’t wants to do

My question if she did not take the offer she has for 30month extension, does that make her illegal since her current leave to remain expired in 12/02/2021 which is like 12months more.

THEY OFFER HER 3OMONTH EXTENTION INSTEAD OF ILR

WE HAVE WRITTEN A LETTER FOR RECONSIDER STATING SHE HAVE LEAVE WITH ME FOR 7YEARS AS MY DEPENDENT.

THEY SAID WE HAVE UNTIL 24TH JANUARY 2020 TO TAKE THE OFFER OR CASE CLOSE

TO TAKE THE OFFER MEANS WE NEED TO PAY £1000 FOR IMMIGRATION HEALTH CHARGES.

PLEASE ADVICE URGENTLY.

She needs 60 months on ILR dependent visa. You cannot combine other visas categories to make up 5 years. The 60 months is clearly stated in the immigration rules.

Correct. You cannot combine time spent as a Tier 2 Dependent with ILR Dependent time to make up 5 years.

No, she has a valid visa, nothing changes and it remains valid. Apply for ILR again when she meets the requirements in December.

This is an example on why you should seek advice BEFORE applying for an application. PBS routes are SEPARATE from family/partner visa routes and cannot be combined
