Evidence required for ILR application for Tier 2 dependent

Dear All,

I have recently obtained my ILR via the Tier 2 route. Now i would like to apply for ILR for my wife who is currently on Tier 2 dependent visa.

However, i am struggling to understand what are the documents that the UKVI is expecting in support of her application. I couldn't find a guide document from UKVI regarding this type of application.

Can you please advise on this if anyone has gone through this experience recently ?

I assuming she requires the following:
1. English test at B1 level
2. Life in the UK test
3. BRP
4. Passports

Is there is any required from me ? Or as a proof of address.

Also i am assuming that she will have to apply using SET(o) application (since her current leave is Tier 2 dependent), correct ? The fact that I, her husband, obtained ILR doesn't make a difference on the type of SET application, right (i.e SET(o) vs SET(M) ?

3 different documents covering in TOTAL the two years, showing you two lived in the same address.

It does. That is why it is SET(O) as you were granted ILR under PBS and she is applying under PBS too

ILR for tier 2 dependent application query

Dear All,

I have recently obtained my ILR (via the 5 years route of tier 2) and now my wife (on tier 2 dependent) have completed her qualifying period for ILR. We are currently in the process of filling her Set(o) application, however, i have some questions regarding the application form:

1. In the "start" of the application, UKVI is asking for information about "The person you are joining or accompanying" and "Which visa is Mr xxxxx applying for or been granted?". There is only a scroll down list that i can choose from (which list all the different types of Tier 2 visas), however, there is no ILR option to select from. They even ask for my employer sponsor licence number ! i find this is very weird.

2. from other threads in this forum, i understand that we need to provide cohabitation documents. So to this end, what is the time length that we need to cover 2 or 5 years ?


Can you please advise on these matters.

1. Choose Tier 2 and provide information requested.

2. For 2 years.

Thank you for your swift reply.

That is interesting, because the UKVI states the following requirement for ILR for tier 2 partner:
"they’ve been living in the UK with you for at least 2 years if they applied before 9 July 2012 or 5 years if they applied on or after 9 July 2012"

The way i interpret this is since we are applying after the 9 of july 2012, we should proof that we have been living together for 5 years.

Is there a guidance that state that it should only be for 2 years ?

That refers to the VISA length required for ILR.

For cohabitation, it is two years evidence.
