ILR minimum earning threshold and English language

Hi all,

If anyone can help me with the following query :

1. As I know to get ILR, I need to comply with the minimum earning threshold which should be confirmed by payslip and a company letter. My question is, how many months before my ILR application do I need to show that salary in my payslip ? Is there any minimum period I need to show that salary for? Such as 1 year, 6 months or 3 months etc...

2. Regarding language test at level B1 for speaking and listening, when I got my Tier-2 visa in 2016, I had given UKVI IELTS for Reading, Writing, Listening and Speaking and after that my tier 2 visa was issued. That certificate is said to be vaild for 2 years but is not written on the certificate. My question is, can I still use the same UKVI IELTS certificate for my ILR language requirement even though it has been more than 2 years now? I do not think it is realistic for me to do the tests again.

Hi,
I need some advise from experts. I am working as a lecturer and my SOC code is 2312. When initially I got my Tier-2 visa I saw under SOC 2312 minimum salary requirement as an experienced lecturer was £32,780 but recently I have notice there is such amount for an experienced lecturer.

Could anyone clarify followings :

1. What is the minimum salary requirement under SOC 2312 as an experienced lecturer.

2. I am eligible for ILR May'2021. However I do not meet minimum salary threshold (£36,900) for ILR and I am shortage of around £3000, is there anyway I can get my ILR application approve? or I need to leave UK after completion of 6 years which would be very sad !!!!

Kindly advise.

2312 Further education teaching professionals
Lecturer or equivalent (new entrant): £22,243
Senior lecturer / advanced teacher and equivalent: £35,217
Further education management / principal lecturer and equivalent: £38,597

You should earn at least £36,900 (minimum earnings threshold) by May 2021.
You should also earn the appropriate salary a per your SOC (if it is higher than minimum earnings threshold) or else you cannot get ILR

PhD level jobs are exempt from salary threshold requirement for ILR.
Is your job under PhD level? I maybe be wrong but ask the experts here.

If you bothered to click on the link that has already been provided for Appendix J, you will have seen that SOC 2312 is NOT a PhD job!!

But I still have confusion. As under SOC 2312 - I am working as a Lecturer, not as senior lecturer. In that case do I have to comply with appropriate rate for senior lecturer (£35,217) eventhough I am working as a lecturer.
Could you please clarify.

Yes. If you bother to read the link provided, the rules make it clear that 'new entrant' rates do NOT apply to ILR.

The minimum salary for an experienced/senior lecturer is set to £35,217
The minimum earnings threshold is also will be £36,900 for all ILR applicants from May 2021
For ILR, you must earn a salary that is at or above the the higher income requirement between the two.

So between £35,217 (experienced/senior lecturer) and min threshold £36,900, the latter salary requirement is higher so you must earn at least £36,900 in May 2021 to get ILR :!:

Many thanks for the above clarification.

However, still there are some ambiguity. My first Tier-2 visa was issued under SOC 1161 in May 2016. Then I changed my job in Dec'17. When I got my COS for present job in Dec'17 under SOC 2312, the experienced lecturer salary was mentioned £32,780 and my employer gave me that salary and I got tier-2 visa. Otherwise I wouldn't get the visa. Recently it appears that expereienced lecturer rate has changed to £35,217. Since my COS was issued before this new rate, Do I still need to be comply with £35,217.

Appreciate if you could kindly advise your thought about this appropriate rate. I understand I need to earn at least £36,900 to get ILR.

Yes you need to meet the new salary threshold as per your SOC in Appendix J. The rules for settlement are not the same as extension.

However another issue now. My present visa is expiring on 14/01/2021 and my ILR application date would May'2021.

That means I have to renew my visa before ILR application. My initial COS (SOC 2312) was issued under appropriate salary that time which was £32,780. However as per new updated salary under SOC 2312 in Appendix J now is £35,217.

So, my question is for renewal visa what is the requirement? Do I have earn salary £35,217 to renew my visa?

Appreciated your kind assistance regarding this issue as my employer do not know anything about this.

Please help me with the correct advise.
