Tier 2 ICT to ILR (long residence - 10 year route)

Dear members/experts,

I am on Tier 2 ICT visa and wanted to know whether I will be eligible to apply for the ILR on a 10 year route

Here are the details

Visa issued on 5th March 2011, Duration 2 years - 5th March 2013
Entered UK on 1st October 2011
Extended leave to remain on 5th March 2013 - duration 2 years - 5th March 2015
Extended leave to remain on 5th March 2015 - duration 2 years - 4th March 2017
I left UK on 15th February 2017
Fresh Tier 2 ICT application made to UK embassy from India on 1st March 2017 - Visa Rejected
Admin review 1 - rejected April 2017
Admin review 2 - approved 15th July 2017 , duration 5 years, valid till 15th Aug 2022
Travelled back to UK on 16th July 2017 - after a gap on 5 months.

Other than the gap mentioned (due to visa rejection/admin review process delays), I have had a continuous residence.

Could you kindly advise if I would be eligible to apply for ILR in Sept 2021?

Yes you will be eligible if your total absences in the last 10 years is less than 540 days

Hi amanhora07,

can you clarify the reason for rejection and does the 12 month cooling off period not apply in your case?

If you read the post properly, you will see the op is and has been on tier 2 ICT since march 2011. They have not mentioned anywhere they applied for tier 2 general.
