ILR : Dependent Route

Hi All,

could you please help me with the below query :

I have come to UK on Independent ICT WP on Oct ,2014 and changed as ICT Dependent on May, 2015.

-Renewed from May 2015 to April 2018 in ICT Dependent visa.

- From April 2018 applied FLR on Article 8 and obtained FLR which is valid till 2021.

1. Am I eligible for ILR in Partner route as I complete 5 year route in May 2020?

2.Am not eligible for ILR Partner route as my status changed from ILR Dependent to FLR(M) - parent route as this was obtained due to my son ?

3. If am eligible how soon can i apply for ILR , i.e, April 2020 or my independent ICT i.e, OCT 2014 can this is calculated while applying.

4. No Absence more than 150 days in total.

Kindly advice on the same.

You are not eligible for ilr. You cannot combine ICT dependent time with FLR article 8 time. It isn't about 5 years as partner in general, it is about holding a qualifying visa. FLR m is a partner route visa. If you got FLR based on your child, it is FLR fp patent route.

If your FLR is on the 10 year route, the earliest you can apply if you meet all the standard requirements is October 2024 based on 10 years long residence

If you FLR is the 5 year route, you need 5 years on FLR before you can apply for ilr.

Your approval letter will likely state what route and rules you are on.
