MAIN APPLICANT HAS ILR HOW DEPENDENT CAN APPLY FOR SETTLEMENT

Hi Everyone

I was on Tier 2 & recently got ILR through 10 years long residency route. My wife came to UK in March 2017 for the first time since than she had an extension of 3 years as a PBS dependent in June 2018. So her visa is expiring in June 2021. My questions are

1- When and how can she apply for settlement ILR visa as at the time of expiry of her visa she would have spent only 4 years 3 months in UK as a PBS dependent.
2- My son was born in UK when I was on Tier 2. Do I need to apply for naturalisation or Can I apply directly for his passport?

1. You wife cannot get ILR under PBS route as you got ILR under long residence. She must switch to family route using FLR(M) and start her ILR clock from scratch
2. Your son is NOT British as he was born before you settled. You should register your child first as British using form MN1.
