UK Tier 2 ILR Visa

Dear Team,
If I am applying for ILR on May 2020, as per my SOC code experienced worker salary requirement is £34,800.
For ILR, since I am applying after 6th April 2020, I checked on website, the minimum salary requirement is £36,200.
So, if my COS is assigned for salary at £36,200 do you think it will be fine for ILR application. or shall i get the salary £36,500 on the COS to be on the safe side?
Please advise.
Best Regards,
Vivek

Dear Team,
In addition to my above query please advise if the employee 5 years is ending in Feb 2021 and employer is willing to support the employee for ILR. So on the COS does the employer need to put end date of Feb 2022 in order to show to home office that they are supporting employee for ILR?
Please advise.
Best Regards,
Vivek

You're over-thinking bro.
You need to demonstrate the minimum salary requirement for ILR at the time of ILR application, not at Tier 2 extension. So as long as your salary on the CoS is in line with the SOC code for your occupation, you're fine. Worry about ILR salary requirement at the time of qualification, not now.
Also, you need to be on Tier 2 for minimum 5 years to qualify, anything over is bonus, not a necessity. If you want to have a buffer of a year, that's totally up-to you, there is an associated cost.

Please can you advise one last thing, for SOC Code 3545, experienced salary worker minimum salary requirement is 34800, is it calculated based on 39 hours per week? I am not able to find anywhere online to confirm this?
Please advise.

Vivek

Tier 2 ILR Visa Application

Dear Team,
I need your help to clarify following points for Tier 2 ILR Visa application with regards to absences:
1. I came to UK in March 2014 on Tier 4 Visa. I was in the UK when I submitted my Tier 2 visa application.
On 10th June 2015, I received my Tier 2 Visa. The start date on COS was 4th May 2015.
Just after receiving my visa, on 10th June 2015, I went for 2 weeks to India for my brother's wedding, but since I need to go to wedding, my employer agreed to start my job on 1st July 2015.
So, since my start date was 1st July 2015, these 2 weeks in India wasn't taken from my holiday allowance.
Do I need to give any evidence to Home office for this 2 weeks absence and please advise what evidence I need to provide? Does this absence outside UK before joining the employer will create any issue?
2. During my 1st 3 years employment, with this 1st employer I went outside UK for total 68 DAYS out of which 5 days were unpaid leave. So, do I need to get letter from this 1st employer confirming all these absences?
The unpaid leave absence will that create any issue with the application?
3. In the letter from current employer where they have explained the requirement in foreseeable future, do they need to provide any timeline such as for next 2 years or 3 years they would need me? As well as, I don't have any absences planned outside UK for next 2-3 years, so in this letter employer hasn't mentioned anything about absences? is this ok?
I would be very grateful to receive you reply.
Many Thanks.
Best Regards,
Vivek

You need to get an absence letter from your previous employers. Absences will not be an issue. Foreseeable future means 'no timeline'

Thanks very much for your advise.
Please kindly clarify following:
Please can you share Absence letter template.
In this letter does the employer need to specify the absences as paid or unpaid leaves?
The 2 weeks absence which I have taken before starting job with the 1st employer, does my employer need to specify in the absence letter as unpaid leave?
It would be great help.
Best Regards,
Vivek

All absences from work should be specified. Absences previous to starting can be ignored

Hi Vivek
I am a bit confused.
For ILR application do we need a new COS? SOC code will be our previous tier 2 COS? Am I right?

You do NOT need a new CoS for ILR. You complete your last cos details if asked for it.

Dear Team,
If someone stayed in UK for 2 years on Tier 2 dependant visa and then switched to 3 years Tier 2 General leave to remain visa.
Please advise does 2 years of tier 2 dependant visa would count towards TIER 2 ILR?
I would really appreciate your help in this regards
Best Regards
Vivek

No. You cannot combine tier 2 dependent time with tier 2 main visa holder time to make up 5 years for ilr. You need 5 years as a tier 3 dependent or 5 years as tier 2 general main visa holder.
