FLRM EXPIRING - INDEFINITE VISA DUE BUT LOST JOB DUE TO COVID-

HI ,

so long story short , a family members is in a very difficult situation financially due to job loss because of corona pandemic and mentally because he lost the job, the only way he could extend his wife's visa into Indefinite leave to remain as she completes her 5 years on FLRM this july- ( meeting £18,600 income requirement through this job which he has lost).

right now out of work for two months , no payslips of these two months , and the total income of the last 12 months combined is no where near £18,600 . and the partner doesn't work because she looks after two kids.

A solicitor has advised to go for FLRM instead of ILR and put in a cover letter stating due to the Global pandemic i lost the job and hence cant meet the financial requirement and if some discretion can be used and she can be granted leave to remain in the uk , as they have two British kids too.

can you guys please advise -

(he does not have enough savings to meet requirement , he did not have work prior to this job he started in October so 12 months payslips even if added wont meet £18,600 requirement )

Solicitor is clearly wrong who perhaps suggesting to rely on miracle because UKVI hasn't yet offered any leniency/benevolence over not meeting the financial requirement. FLRM and SET(M) have same financial requirement.
