ILR Dependant

Hi there,

I have few question regarding ILR dependant and seeking for some suggestions please:

Main applicant is on Tier 2 General and will be completing 5 years on September 20th 2020 and our visa is valid till October 2020.
1.When can main applicant submit the online application at the earliest?
2.When can main applicant book for biometric appointment?

Spouse of main applicant came to UK in July 2012 in Tier 2 ICT and then switched to Tier 2 General dependant in November 2015. However Visa is till October 2020.

1. When can spouse apply for ILR?
2. Should spouse apply separately as spouse is not completing 5 years on dependant visa on 20th September 2020?

No sooner than within 28 days before the 5th anniversary of your initial Tier 2 visa issue date.
2.When can main applicant book for biometric appointment?
You can only book an appointment AFTER you have applied and paid online.
1. When can spouse apply for ILR?
No sooner than within 28 days before the 5th anniversary of their Tier 2 dependent visa issue date.
2. Should spouse apply separately as spouse is not completing 5 years on dependant visa on 20th September 2020?
Yes.

Thanks for your prompt reply.

The spouse dependant visa was issued on 26-11-2015, however it expires on 21-10-2020 which is when the main applicant Tier 2 general visa expires.
So the visa expires 28 days before the 5 year anniversary on 26-11-2020.

Does this mean the spouse will need to go for a PBS dependant visa extension?

Apply before visa expiry, book the appointment for a day when eligible for ILR. If you are eligible on the day of decision, ILR is granted

I have a further query regarding the SOC code in the employer letter. Should it be according to the COS which was generated 5 years ago or the code should be the nearest to the current job title. The current title is different from the COS due to promotions.

It should be the latest COS issued to you, for most of the people it is the one they get during extension

My COS was generated 5 years ago and the current role is expansion of the role which is in the COS.So I should use the same SOC code as the COS.

One more query, should the Employer letter be dated before the application submission date?

Shouldn't be older than 28 days from the date of application.

When filling the form I can see that same day travel outside UK is not accepted. Do I need to skip these?

Departure date/arrival date is not counted. So you can skip such travels for instance:

If you travel on a Mon and back on Tues will not be counted.

Also same day travels will not be counted either.

If it is a single day, fly in the morning morning and return in the evening, you don't have to count that.

For joint account holders of any documents provided, the applicant will sign Part 1 of consent form and the joint account holder will sign Part 2. Is my understanding correct?

Do we need to provide any other documents of the joint account holder like passport etc in order to do checks?

For the employer letter detailing the list of absences due to business travel, is it fine to mention the dates of absences or need the reason for each trip?

Hello moderators,

One more question. The UK NARIC is providing PDF. Is that fine to upload as the NARIC letter?

also the assessment had an outcome of UK Qualification level-> Bachelor (Honours) degree and English language level: CEFR level C1.

Yes they are Ok, if letter is in any other form you are probably still going to have to convert to PDF to be able to upload anyway.
