ILR SET(LR) Query

Hi
I am eligible for ILR SET(LR) on August 12 2020, but due to Covid situation will not be able to apply through Super priority service. I work for an Indian company and am on Tier 2 ICT Visa which expires on 10 Sep 2020.
My query is what happens if I go through normal process with decision time 6 months, will my company be able to generate a CoS during this period?
If my company asks me to go back to my country can I switch Job during this period?
Do employers consider such ILR applications which have decision pending?

Your existing visa conditions continue while you have an application processing with HO, Section 3C of the Immigration Rules. You cannot make another application as you can't have two applications with HO at the same time.
If my company asks me to go back to my country can I switch Job during this period?
You cannot change jobs or work for another employer while you have an application pending. You can only work for your tier 2 sponsor until your ILR is granted and you have a new BRP.
Do employers consider such ILR applications which have decision pending?
No, you cannot work for anyone else except your tier 2 sponsor. Having a pending application does not change this.

My further query is can my current CoS expires mid August so if I apply for SET(LR) can my employer(Indian Company) generate CoS for my ILR SET(LR) application or does the application needs to be Tier 2 ICT?

Also can the employer file ILR SET(LR) in this case?

Set LR is NOT employer specific and does NOT require a CoS.
Also can the employer file ILR SET(LR) in this case?
Set LR has nothing to do with your employer. You as the applicant must meet the requirements, which also has nothing to do with your job.

I'm in the same situation! I hope priority service will resume by end of July as furlough scheme terms going to change and social distancing rules might be relaxed and most of the staff will return to work. Just Sit tight, Finger Crossed!

I had another query, if I applied for ILR(LR) under ICT category(issued before April 2011) and if my employer asks me to leave country as they don't have any assignment, can I quit them and stay till decision is made for my ILR application is decided?

Yes. If you apply before visa expiry for SET(LR) you can stay until you get a decision.

While filling the ILR SET(LR) form there is a question in Current Partner section
When did you start living together?

Is this date the date of marriage?
My wife has been living with me since 2010 and was out of UK for 1.5 years in 2016, then again 4 months in 2019, so which date should I mention?

Not important. Say 2010

For SET(LR) do I need to upload all passport pages(including blank pages) or just the pages where immigration stamps and VISA is there?

Best to upload all pages including the blank pages.

I have applied for SET(LR) for myself on 2nd Aug and have applied for FLR(M) for dependants on 10th Aug, since their existing Visa(ICT PBS Dependants) is also expiring on 20th Aug. Is it OK to apply now or should I wait till I get my decision.
Is Section 3C applicable for family as well if I only apply for ILR?
Should I withdraw the FLR(M) application for my dependants?

You must apply FLR(M) before the visa expiry if their visa is expiring. Also include a cover letter than you have applied for ILR(LR).

Thanks, I got confused by one of the threads here but the difference was that their leave to remain was expiring in June 21. There it was advised that dependants FLR(M) was not required and they can wait for ILR decision which was applied in July 20, your reply make it clear now.

I have applied for SET(LR) and done biometric on 9th Sep. Biometric for my dependants is on 18th September for SET(FLRM). My doubt is that there is a declaration form which I have to sign which says 'I have an ILR', which is technically not right as I have yet not got the decision. So , should I cancel Biometric for dependants and reschedule when I get decision or this doesn't matter?

NO. Their application will be processed when you get ILR as it is based on your ILR. Do NOT do anything silly :!:
