SET(LR) Application

Hi Zimba,

I need your help.

I am applying for ILR on a 10-year basis. Currently, I am on tier 2 General. My Partner is on a dependent visa came in UK 2017. I have 3 children born in the UK. Youngest one is 3 months old and I don't have any passport for him as there was no appointment in the Embassy.

I have applied my ILR but my wife and children visa gonna expire soon at end of July. so I have to apply for them.
My Wife, I will apply for a Family visa extension?
My 2 children dependent on my wife application
My 3rd child? as he has no documents, do I need to apply for him as well or not and will wait for my ilr and then will apply for a passport.

My Wife, I will apply for a Family visa extension?
She needs to switch to FLR(M) spouse visa and meet the English and Financial requirement. Her 5 years ILR clock will reset to zero.
My 2 children dependent on my wife application
My 3rd child? as he has no documents, do I need to apply for him as well or not and will wait for my ilr and then will apply for a passport.
You do not have to apply for a visa for any of your UK born children. Once you have ILR, you can register them as British on form MN1.

Thanks for your prompt reply. In this case I can save lot of money.
Just bit wondering, my 2 children have dependent visa and will expire end of month. I called home office they told me 2 children I have to apply as dependent with my partner application and 3rd one I can wait for my ILR and can apply direct nationality. Now I am worried just in case if their visa will go expire and home office will turn them illegal. If you don't mind can you please reply about this aswell as I am very confused.

A UK born child has an entitlement to register as British (cannot be refused) and they do not need a valid visa to be able to do this.

Note also that the ukvi call centre is a third party agent that gives generic and often incorrect information.
