6 Days Short for ILR

Hello Experts

I just need some help regarding my ILR application as there is 6 days gap between entry clearance and expiry of visa. Details as followed

I am on TIER 2 General Migrant visa

Date of entry clearance 6-10-2015
Valid until 30-9-2020

My question are
1: can I apply for ILR still, as there is a gap of 6 days or I have to go for extension in Tier 2. I am not sure how qualifying period is counted.
2: If I can apply for ILR , which date to consider for applying, means "28 days before" will be from entry clearance or valid until date.

You can apply online within 28 days before the initial visa entry date, ie. 30 September 2020.

do you mean initial visa expiry date i.e 30 sept 2020? or entry ? I am sorry for being confused

You can apply online 28 days prior to the start date of your current T2 visa.
If you delayed your entry for a long time after the start date of your visa this may be different and count towards your absence days.

What is the start date of the visa you are basing your application on? Is that 6/10/2015 or was that the date of your entry first entry to the UK?

Yes my start date of visa is 6-5-2015 and yes i am basing application on this date.

My entry to country was 28october 2015 which I am not taking as base for application because guidance says duration between visa start date and entry to country is counted as qualifying period.

Now I am confused. You have put the following dates in your posts:
Start date of visa: 6-5-2015
Date of entry clearance: 6-10-2015 (what is this?)
Entry to country: 28-10-2015
Valid until: 30-9-2020

If your visa started in May 2015 then you would need to base your first date of application as 28 days before date of entry. 28-10-2015 minus 28 days is 30-9-2020 (same date as your visa expiry!!)

If your visa started in October 2015 and you entered the country in October 2015 then you can apply 28 days before the start date of your visa. 6-10-2015 minus 28 days is 8-9-2020.

I do apologise. Start date is 6 October 2015.

That 6-5-2015 was typing mistake.

Dear Experts

I am on TIER 2 General Migrant visa.

Date of entry clearance 6-10-2015 and it was Valid until 30-9-2020 but now same Tier 2 is extended till
30-9-2021 under Covid NHS worker
.

I will complete 5 years on 6-10-2020 , my question is when can I apply for ILR , Is it on 6-10-2020 or 28 days before this date (keeping in mind this 6-10-2020 is not expiry date of my TIER 2 now) I want to apply for ILR as soon as possible to change employer then.

also if anybody have an idea when priority service will open.

28 days before completing the 60 months from the date of visa issuance instead from date of entering the UK.

Your question was already answered above (topics merged) when you asked in April. The answer doesn't change!

None of us could possibly have any idea when priority service will resume. They are currently dealing with biometric appointment for those who applied in may, so there is a huge backlog.
