ILR for my wife Set (LR) and children Set (F)

Hi all,

I have my ILR in 2013 on Long Residency basis. My wife and children are now under FLR-M visa. They are now nearly at their 2 and a half year visa expiry.

My wife has now completed her 10 years with any visa and can apply for her ILR under Long residency. She is going to apply for Set (LR).

I also wanted to apply settlement for my children. From what I read, they need to apply under Set (F). Can anybody confirm this for me?

I forgot to mention, my wife's visa was Student+Tier 2+FLR-M.

My daughter are all born in the UK, they are 11 and 9 years old.

Your UK born children do NOT require ilr if you plan on registering them as British. They could have applied for citizenship once you got ilr

Thank you CR001 for your quick response.

I am not planning registering them as British, hence the application for ILR for them.

Can you confirm for me whether I am in the right direction for their Set (F) application?

I have another question in filling up the Set (F) form, who do I need to put in the Sponsor? Is it me or my wife?

I have already gotten my ILR in 2013, but my wife is applying for it. If my wife will be their sponsor, where shall I put my details so that it is going to meet the requirement for both parents have settled / ILR?

The ILR holder parent must be the sponsor. Make it clear that you are relying on the UK born child rules or request that they wait until mother is granted ILR. Else, they may refuse when the requirements of 298 are not satisfied.

It’s simpler to register a UK born child because of child’s entitlement.
