Tier 2 Job Switch when eligible for ILR

Post by JackRibena » Tue Sep 01, 2020 11:37 am

Hi all,

I have been holding Tier 2 visa for 5 years hence got eligible for ILR.

I have also agreed with my employer to move to a new role which requires SOC code change (hence new TIer 2 application)

Because of uncertain processing times for ILR applications (due to Covid up to 8 months) and in order to start the new role asap i have decided to apply new Tier 2 instead of submitting ILR application.

Am I ok with doing that providing total time on Tier 2 does not exceed 6 years in total?

Thanks a lot in advance!

Great thanks a lot for such quick reply!!! Didn't expect that :)

Also based on Covid guidance below I would be allowed to start work while application is pending correct?
(which could take up to 2 months of standard processing times):

Redundancy risks while ILR application is pending

Post by JackRibena » Wed Sep 23, 2020 10:14 pm

Hi all,

During the COVID the application process may take up to 6 months which is a rather long time period and things may change job wise...

If while your application is pending the company decides to make you redundant (and gives you 2 months notice)?

Will that affect your ILR application that is still being considered?

Thanks a lot for your advice.

Kind Regards,
Jack
