Hello all i need some advise please.
Married and on the 5yr route.....renewed my visa and will be due for ILR in Dec 2021 however my marriage has broken down. Whilst there is no violence there is alot of emotional and financial abuse.
He has told me he is moving out if i refuse to move out. So my question is (1) do i need him to support my application for the ILR next year
Is there a diff category i can apply to as communication is broken down completely between us
I appreciate any supportive comments please

Yes.

If you have evidence of domestic abuse you could try Set DV form, but you need evidence of abuse.

Passport, financial requirements depending on who is meeting them, marriage cert and you need 2 years evidence of cohabitation in both your names. He also has to sign a consent form.

Mods n Gurus, noting she has come thus far, if he is unwilling to support her for ILR, what option(s) open to her to get ILR? That's more like the question.

In case of break down of relationship, the sponsor can simply report to UKVI which leads towards the curtailment of your existing visa. A lot of times the visa holders don't update their contact info with UKVI, therefore, any similar notification is delivered at the last known contact information, and the same won't avert any curtailment even if the visa holder subsequently claim of receiving nothing.

Without the spouse support or strong evidence of domestic violence, there isn't one.
If the OP has a British child, they can apply for FLR FP parent route, starting from scratch again

The spirit of the change from 2 years to 5 years ILR was to ensure relationships were lasting and sustained. You should get professional advice as there may be other routes available to you depending on your personal circumstances.
