ILR Complications

Dear members,
I am using this platform first time I am very confused I have many questions about my indefinite leave to remain I am on spouse Visa my husband is British national and I have 2 years old British national son.

1st I was arrived on spouse visa in 15 /12/2015
My visa extension from 26/10/2018 to 28/04/2021
My 5 years will be completed on 15/12/2020 when earliest I can apply for my indefinite.

2nd since 2015 to till now me and my husband working full time due to COVID19 my husband was on furlough but now his employer gave him redundancy.
He lose the job but he get last wages in October from April 2020 to till now my salrey and including furlough about gross 2800 pounds per month .
Now I am working full time only about gross 1500.
Pound.



3rd since 2015 we are living in joint family with my brother rental accommodation.
The agreement is me and my husband and my brother.

In September 2020 the Council Home inspection team inspected the house because the house was full of fungus.
after inspection they give us a notice to equit the property with in 28 days when we received the notice that time already 10 day gone. And give warning to Landlord to fix the property .
The house inspector understand it's not possible to get the property with in weeks in Covid he advise to go Council homeless department because my husband and son is British.
They give us a temporary accommodation they said your income is over you are not intital for housing Benefit we have to pay.

But when they fill the application my husband was main applicant and they also took my details in application as spouse partner.

As long as they are looking for permanent property then they shift us in permanent property.

Can I apply ILR on this temporary accommodation
The agreement is on my husband name.
Is there any effect on my ILR if we get the council permanent property..

Right now we are not taking any kind of Benefit only Child benefit. And also paying this temporary accommodation 1000.00 pounds per month. They advice to my husband take universal credit but he refuses it may effect on my ILR.

I am very depressed I need your support my brother advise me for this forum he get lot of help from this forum.

I am very desperately waiting for your response.

If you wish then can rely on category B to combine all of his previous income with yours. Alternatively, If you are earning variably and have earned at least £9300 during the last 6 months then instead can simply rely on category A by sidestepping your partner's income.

No issue as long the sponsor (settled/British citizen) remain the principal applicant of that tenancy.

Same documents as were inherent in your last FLRM extension except B1 test & LIUK test.

As aforesaid, it wont cause any issue. Regardless of the landlord either a private person or housing association/council authority will retain the detail of every occupant for referencing and health & safety purposes.
