I am currently on my second spouse visa for the UK (I am Canadian, husband is British) and would like to know when is the earliest I can apply for ILR.

My original visa was issued on 10/06/2016, I was already in the country at this time on a Youth mobile visa ( I know I can't count those years towards ILR), I applied for my second spouse visa and had it issued to me on 14/02/2019 with the expiry date of 01/08/2021

Would I count 5 years from 10/06/16 and be able to apply 28 days in advance or do I need to wait for the expiration date of 01/08/2021 and be able to apply 28 days prior to that date?

You can apply no sooner than within 28 days before 10/6/2021. The latest you can apply is shortly before your current visa expires.

Yes, the date of application is the date you submit and pay online. That is the date that is relevant to the 28 days early concession.

Note that currently the priority and super priority service are suspended.
