Hi

I will be eligible for ILR based on SET(M) in June 2023. However, I will also be eligible for ILR based on SET(LR) because in Dec 2022 I will have legally spent 10 years [5 years point based dependent + 5 years FLR(M)].


Question 1: After 10 years of lawful residence, am I eligible to apply for ILR through the SET(LR) route, even though I am currently on FLR(M) visa?

Luckily, till now we have manged to make our applications without help from solicitors, which bring the next question.


Question 2: Does SET(LR) route require less documents and is easier than SET(M) route?

My wife is in same position as 10 years are being completed about 8 months before 5-years.

My question is:
1. if my wife gets ILR based on SET (M), then she can apply for Naturalisation without the need to complete 1 year?

whereas

2. if my wife gets the ILR based on SET (LR), then she has to complete 1 year before she is eligible for Naturalisation?

I had to wait for 12 months after my ILR (LR) but I was spouse of a British citizen. i am not sure if the same rules applies.

Would my wife be able to apply for Naturalisation as soon as she is granted ILR regardless of basis for ILR? SET (M) or SET (LR)?

It makes no difference for naturalisation which route to ilr she is makes/gets.

For naturalisation the requirment to skip the 12 months on ilr is ONLY that you are married to a British citizen.
