ILR queries

Hi Moderators,

Can you please help me with the date related queries for the ILR.

My case:
T-2 General issues for 5 years, Wife came on T-2 dependent from T-2 ICT, Child born in UK.

VISA Details:

Me ( T-2 General )
Issued on: 31-May-2017, Expiry: 21-Jun-2022, Landed in UK: 06-Jun-2017
Wife ( Transferred from T-ICT to T-2 General Dependent. T-2 General Dependent)
Issued on: 10-Jul-2017, Expiry: 21-Jun-2022)

My questions are below:
1) When can I apply for ILR online (I want to be safe than sorry), not the biometric & document submission ? 28 days before 31-May-2017 or 28 days before 06-Jun-2017 ?

2) When can my wife apply for ILR online ? 28 days before 10-Jul-2022 ? Can we start with the application earlier than 28 days before 10-Jul-2022 and just submit the document & give biometric 28 days before 10-Jul-2022 ?

3) Should I go for a extension of my wife, so she doesn't run out of VISA in 21-Jun-2022 ? This is in extension of the Q4 below.

4) Usually in how many days do we get a super-priority appointment (For my wife) in UK ? Assuming in May/Jun 2022 UK will be back to normal ?

1) Use the visa issue date 31-May-2017
2) There was no difference between the PBS dependant visas. She will be eligible when you are eligible as she has 5 years.
3) No as explained above
4) Depends on UKVCAS appointment availability

Thanks a lot Zimba for the response...I am clear on point 1 & 4.

With regards to point 2 in specific, apologies if I am repetitive, but the question is below:

2) My wife, came on my dependent, as per T-2 dependent VISA on 10th July 2017 so her five years complete on 10th July 2022. As I explained earlier, she came over from T-2 ICT, so per what I understand, her ICT time won't be counted.

In that context, I am not sure your response on point 2 holds for her wherein you state that she completes 5 years in May 2022.

Can you please clarify your logic and home office guidance on the same ?

I believe you say she switched from Tier 2 ICT to PBS dependant. In that case, she can apply within 28 days of completing her 5 years. She applies online before her visa expiry but books her biometrics appointment a day later when she is eligible. As long as she is eligible on the day of her ILR decision, then ILR will be granted

Thanks a lot Zimba, I guess my assumption and your answer coincides. I also felt the same as you have explained.
