Hi All,
I am British Citizen and following my route detail to get British passport.
I was on Tier 1 General Visa (From: 10 April 2010 to 6 April 2015). I received my British passport on 2016.
My wife got Tier 1 General dependent visa on the basis of Tier 1 Gen visa and she came in UK on 26th Nov 2014.
Detail Of Wife Visa:
21st Oct 2014 to 6th April 2015 (6 months)
22nd Apr 2015 to 22nd Apr 2018 (3 years)
29th Mar 2018 to 29th Mar 2021 (3 years)
I am going to apply my indefinite on the basis of Tier 1 General dependent visa. I am looking for form to apply online but I am not sure which form I need to apply her ILR.
Note: Since May 2018 I am on part time job (523.20 per month salary) and taking benefits till now to look after family.
My both kids has British passport (age: 2 years and 5 years)
.
Is any problem for my wife to get ILR if I am taking benefits?
Could anyone answer my question please?
Regards,
Gohar

She should use the form SET(O). Benefits do not affect her application as claimed by you but some benefits like UC must be applied together and it might make things more complex

Hi,
Thanks for your reply.
I have one more question please.
I applied UC on May 2018 and told about wife's visa status and then they sent me the following letter.
Dear Mrs XXXX,
We're writing to tell you that unfortunately you're not entitled to Universal Credit.
This is because you have no recourse to public funds; subsequently we have
decided that you do not meet the requirements for the right to reside test so for
benefit purposes only you're not considered to be habitually resident in the UK.
This means that you are treated as not being in Great Britain. Therefore, you
do not have any entitlement to Universal Credit at this time.
If your circumstances change, you can make a new benefit claim. You can do this
online at
www.gov.uk/universal-credit.
Question In Form: Do you or anyone else who is part of this application receive any public funds?(Required)
Include details for your partner or child if you have one. Examples of public funds include Income Support, Child Benefit, Housing Benefit, Council Tax Benefit, Carer’s Allowance and Disability Living Allowance. See a full list
Answer: Yes or No
If i look into the letter that describe that my wife is not entitled so can I select Yes option.
Please advise?
Regards
Gohar

The question is asking about HER or anyone who is part of the application. You (the husband) are NOT part of the application so select NO

There is no maintenance or financial requirement. Any document can be used for the cohabitation evidence but they should be from at least 3 sources

HI All,
Hope you are fine.
Firstly, thanks for all for your quick replies and guidance.
She applied on 26th Mar 2021 on premium basis and got finger print appointment on 23rd Apr 2021.
She went on 23rd April 2021 for finger print at 9:30am and she got ILR confirmation email at 2:00pm.
She received yesterday ILR Card.
I have question regarding applying British passport.
Does She need to wait one to apply British passport?
Please advise.
Regards
Gohar

She cannot apply for a passport because she is NOT a citizen. She should apply to naturalise now as she is married to a British citizen. After her ceremony, she may apply for a passport
