PBS dependant ILR urgent query

Dear all,

I'm completing the 5 year qualifying period for ILR as a PBS dependant. My spouse has already got a ILR through tier 2 3 years ago. Now I've got a question about absences.

I went to work in the Middle East for 9 months after entering the UK with the current dependant visa between 2016-2017, and that period is certainly longer than 180 days (no more prolonged absences afterwards). I understand that absences before Jan 2018 are not counted but what if the purpose of the absences was employment? Do I need any documents certifying it or explain it in any forms?

Also, there is a question on the application form asking 'have you previously lived in a country outside of the UK'. Does it mean time spent outside of the UK before the current leave to remain? Do I have to declare the 9 months in the Middle East.

I apologise for my undue anxiety.

So does it mean that I do need to declare the 9 months which were for work purpose, however it is not a negative factor for my application regardless of the nature of the absences?

Declare it truthfully. It will not impact your application as you meet the residence requirements. No need/requirement to prove anything but you might be asked for a “reason” in the online form.

Thank you very much Cullinan. I will just mark the reason in the online form as 'Employment/Work'. If it is not causing further complication I won't be bothered with it.

When was your last visa granted? Date?

Also the “living” in question starts from DOB. So declare all countries you “lived” in starting from DOB onwards.

Hi I entered the UK in May 2016 on PBS dependant, and then I went abroad for work in September for 9 months through 2017 before I returned to the UK. I extended the PBS dependant once in 2018 which runs until Nov 2021. So my understanding is that I will be eligible to apply for ILR this year regardless of the 9 month which took place before 11 Jan 2018?

If the above is correct, is it good that I listed my country of birth as well as the country for the 9month in the 'living abroad' section?

Sorry, just to add that my last leave was granted in Nov 2018

You will list absences only after Nov 2018 not Jan 2018 in your case.

Declare the live in countries.

Dependant ILR confusion

May anyone shed some lights on whether tax issues are civil or 'bad character'.

I'm applying for ILR based upon PBS dependant and I had some foreign income while working abroad in the beginning. I'm not very sure if I need to declare and pay tax on it but am going to find out. How deadly will that be for the ILR?

So many T1 people got refused because of making legal late payment, and I'm really confused.

You were already advised that the tax issues you refer to for T1 migrants was specific to Tier 1 General main visa holders only.
