10 Years ILR with BV and ICT

I have seen experts here have clearly articulated and explained that EVERY VISA counts under 10 years provided legal continuous stay. However, when we take this to immigration lawyers they are not very confident or start with No but failed to provide any clause or statement. I also saw many people asking if their stay on BV counts towards ILR but wanted to check and confirm, how many of you have successfully got ILR under this category? Hope, this is not a gap in the Immigration rules which are used for ILR and likely to have issues later? Thanks in advance

In this context, what is "BV"? It is not a common term on these forums.

I had never come across that abbreviation. I thought the OP mistyped DV.

To the OP: as you have already been advised, all legal residence in the UK under any type of visas (including visit visas, which are the most restrictive visas in all other factors) count towards ILR (LR), provided the single and cumulative absence requirements are met.

10 Years ILR with 552 days

I am planning to apply for ILR under 10 Years rule. I came to UK in Jun-2011 and will be completing

10 years on 6th June-2021, however total days outside UK is coming out to be 552 days as I was stuck in my home country from Dec-20 to Mar-21 as my flights got cancelled due to COVID and flight restrictions imposed. I have attempted to book fresh tickets but did not get any availability. I am satisfying 180 days criteria -My questions.

1. Will they consider this as an exceptional circumstance and consider my application?

2. If I apply after 18 June-2021, which would make it 10 years and 12 days, will it work?

Thank you Zimba. Can you please give your expert opinion on the second point? This 540 days period is counted from the first entry in the UK till you complete 10 years in the country?

The 10 years can be any lawful period of 10 years you spent in the past. That date must be either from a date that you entered the UK initially or any date after it. Also in that period, you must not have been absent for more than 540 days.

Congratulations UserILR2021.

I'm in a similar situation and I'm putting off applying for my ILR until I have some form of certainty that it'll be approved.

Could you please list what evidence you used to prove that you couldn't come back as a result of COVID and travel restrictions.

I currently only have the Government communiques on travel restrictions which were published on the governments website.

As there were some flights operating, I tried booking tickets and provided all tickets and cancellation emails from airlines. I actually booked 6 flights and 5 of them got cancelled.
