ILR SET M with DLA

Hi Team/Everyone,

My husband is about to apply ILR set M as spouse of British Citizen. He is working part time and taking approx £10000.00 yearly.

I'm as a British taking DLA for my daughter and universal credit £2000 for 4 kids, I'm not working. DLA for my daughter is on my name and UC we applied as a couple and been told my husband is not eligible ( that what we need ). Questions

- Is DLA is going to effect on my husband application for ILR?
- Are universal tax credit going to effect his application?

If we can, thinking to to apply through DLA route and wondering what documents do we need to apply?

I do have DWP letter for DLA but no paper is for UC but it does come in my bank and have bank statement.
Please guide, need to urgent advice. Thank you!

Anything you claimed under your name as a British citizen is fine and has no effect on his application. UC is more complicated as your eligibility is assessed as a couple. Also when you are under a spouse or partner visa, your partner is expected to support you financially for your first 5 years in the UK.
If your partner is a person subject to immigration control you must claim Universal Credit as a single person. However your partner’s income and capital is taken into account.

If your partner’s leave is subject to a no recourse to public funds restriction, you should seek specialist immigration advice before making a claim, if you and your partner are joint tenants. As your partner’s share of the rent is used to calculate the housing element of Universal Credit, this might be considered as recourse to public funds, which could affect their right to remain in the UK.
