When is the earliest I can apply for ILR ( Spouse)?

Greetings, Please I would like to know when the earliest date in which one can apply for ILR is.?

Spouse visa issued abroad on 15/10/2016
Date of Entry 02/11/2016
BRP Expires 05/01/2022

Your SET (M) can be applied for from 02.11.2021 till the expiry of BRP.

Can I apply before 28 days or I need to wait until 02/11/2021

That was not clear in earlier response, you can apply 28 day before 02.11.2021 i.e. you can apply from 5th October 2021 till 5th January 2022.
