Hi All,

My wife came to the UK on a PBS Dependant visa (4 years 6 months) and extended her Visa once I got my ILR as a Dependant partner (validity until 2024).

Please advise, which form should I complete Set(0) or Set(M) to apply for her ILR as he completed 5 years?

I really appreciate any help you can provide.

Did she extend under PBS route? If yes then use SET(O). If she applied using FLR(M) then her ILR clock has been reset to zero and must spend 60 months under family route to get ILR using SET(M)

Zimba,

Thanks for your reply,

Yes, she applied her extension using PBS, Start-up, Innovator or Global Talent dependant partner application.

For clarification, however, BRP Type of permit shown as PBS Dependant leave to remain at the first time, and now Dependant Partner leave to remain. is both same?

Hi Zimba,

I need your help with filling the application. My husband current immigration status is Indefinite leave to remain.

While I'm filling the ILR (Set(o)) application, there is a question about my husband visa being applied for or granted. In the drop-down menu, there is no option to select Indefinite leave to remain.

Would you please guide me on which option to choose?

I'm in the same boat as you. FOr my wife who is on PBS dependent and applying for ILR as SET(O) and me being the ILR holder, for this question we chose Tier 2 General since that was the route me (the main applicant) got leave granted in the UK at first

Priority service has no guarantee at all. Your application will take longer if needed. Wait to hear back

Zimba,

Thanks for your response

If it gets delayed, is there any possibility to request to reimburse the fee paid for priority service?

Yes if it has exceeded the published service time and not due to anything in your circumstances or application.
