Hello,

I will have been working and living in the UK for 5 years in February 2022 and I will be applying for ILR. I have been on Tier 2 and Skilled worker visa within this period.

I have all the documents (Life in the UK, language requirement - degree certificate etc. and proof that my employer still needs me for working). I am curious about one thing: will I need to provide a proof that I had been living & working in the UK for 5 years? And if yes, what is the proof of that? Or do they just check their database? The eligibility requirement is as below, but I just thought what documents they might ask from me for the application and how do I prove this 5 year period? The eligibility requirement is as below, thank you.

Eligibility
You must:

have lived and worked in the UK for 5 years - there are rules for what counts towards your time in the UK
meet the salary requirements
continue to be needed for your job and meet the salary requirements after you get indefinite leave to remain - you’ll need a document from your employer (sponsor) to confirm this
If you’re not eligible using your T2 or Skilled worker visa, there are other ways to apply for indefinite leave to remain.

There is no proof needed. Just submit passports covering the last 5 years. They cross-check your absences on their systems

Thank you.

I have 2 other queries:
1-
I told my current employer that I will be applying for ILR. And hence they told me that they will not need to generate a COS for a visa extension which is imminent.

The HR-immigration told me that I need to count my absences. What does that absence mean? Are these the times I spend out of the UK? But I also have been to conferences and business trips, maybe more than 30 times. In any case, I did not spend more than 180 days in any of the 12 months.

2-

I started working in the UK on 17.01.2017. In a week's time it is going to be 5 years since I moved here and been working. Within that 5 year period when I changed one of my contracts one of my 3 year employment ended and another contract was offered to me. Hence officially I left the University (employer) and started back again in a month's time. Does that mean I need to apply for ILR in sometime in February now?

within that period I never overstayed and I was within my Tier 2 and Skilled worker visas lawfully.

So if somebody can please clarify that would be great.

Kind regards,
Mert

1. All absences from the UK must be declared on the form
2. For ILR, only the first visa issue date counts. Changing of the employers is not important
