Hi all respected board members,

My wife came in this country 12th Jan 2012 and after that she was my dependent and living in Uk legally, went back home for only 3 months in total in 2 different times.

I had applied her last visa Flrfp which going to expire on 13th November 2021.
Now I am applying for her Flrfp extension and while I will fill online form and submit documents it will be another month or so which will fulfil the requirement of 10 years on 10th Dec 2021 I think?

My question is that
After submitting my Flrfp extension can I switch to ILR 10 year route if yes then what will be the best date and way to switch to IlR route?

Second what form I need for switching to ILR route?

Third she is doing life in uk test,
But for English requirement she has done her master’s degree in Stats From Pakistan will it cover the English requirement or is it better to do the B1 test?

Your time and answer will be highly appreciated 😊

Regards

The term 'switch' is not correct here. You mean 'variation' of the application from FLR(FP) to SET(LR). If you are sure that she will qualify under long residence and there are no gaps or overstaying, then I suggest applying for the long residence using form SET(LR) directly and booking her appointment after 10 Dec. NO need for a FLR(FP) step.

SET(LR) Form: https://visas-immigration.service.gov.uk/product/set-lr

Her degree from Pakistan will not be enough unless it is evaluated by Ecctis, I suggest that she sits SELT at B1 as it is much faster

Thanks for your reply but if I will not apply for flrfp extension then there will be one month gap left,
Is it ok not to cover it up and apply for new application SET lr?
Please suggest me a if I am wrong and please tell me the according to the dates as describe will be ok for ten years?

Many Thanks

If she came into the country on 14 Jan 2012 and her Flrfp leave is expiring on 13th of November so she completed lawfully 10 years on 14 Jan 2022.
So I can apply for ILR 28 days before which is 17th of December 2021.
In this case she is 33 days short please help me to understand that is it still ok to apply for ILR?

When you apply for an application and your visa expires, your visa is automatically extended under section 3C until a decision is made. So when you apply a month early but book your appointment in December, you are effectively using section 3C to cover the shortfall. Time spent under section 3C is lawful stay (it's like an invisible extension)

Refunds are processed automatically after variation. To vary, simply apply for a new application while another one is pending
