ILR Application Advice 10 year - Continuous residency

Hello All,

I arrived in UK in 2012 July on tier 2 ICT and stayed legally till 2017 June . I got back again in october 2017 on a visitor visa for couple of weeks and then returned . Got Tier 2 general and arrived in uk in dec 2017. I complete my 10 years in July 2022. Can anyone advice if my case qualifies for 10 year continuous residency . I need clarification if my visit in 2017 october qualifies for the continuous residency

All legal residence in the UK, including visit visas, count towards Long Residence, provided
(a) you left the UK before the end of your visas, Even a single day's overstay can void this,
(b) you returned back to the UK within 180 days on either the same or different visa.

The other requirements (no single absence from the UK exceeding 180 days and total absences not exceeding 540 days, etc) also need to be met.

Thank you for the quick reply and appreciate your help. Can i make ILR application 28 days before the 10 year timeline or i need to wait for the 10 years to be completed

What does no leave either upon departure or return
It means your visa or right to be in UK had already lapsed before you left UK. And probably because of this though you returned to UK within 6months it can not be taken for continuous residence

Just a correction in my visa details

First came in on tier 2 ICT - 5 years
Then Visitor visa - 2 weeks
Tier 2 General dependent - 5 years

My question is can the can the change to dependent also be included in continuous residence

All visas count for ILR based on long residence!

Hi,

I had one last Tuesday (24/05/2022) it was SET(M) and yes they are available.
Check between 12:55 and 1:05 at night and you will get the option.

There is no option coming in the pay section

Try tonight between 1255 am to 0115 am.. you should be able to see super priority options

Hi, what’s your date of arrival in the Uk? Did you apply 28 days before 5 year period or 28 days before visa expiry date? Have you gotten your ilr response?

Just refresh the page. Try at around 12 or 1 am

Also, can you list the documents you will be submitting?

When you make payment and the super priority service is offered.

@Croo, thank. So I have to make the payment 1st then I will be offered the super priority service right?
I'm just not sure and I don't want to make the payment and I can't get the super priority service, hence my question.
