PBS Dependant to ILR

Hello,

I have a few queries regarding applying for ILR for my wife who is currently on PBS dependant visa. Your help is very much appreciated.

Q1. My wife has visa until Dec 2022 but the first leave to enter was granted in Apr 2016 (and she entered within 2 weeks of granting). Effectively, she became eligible for ILR in April 2021 however we were away from the UK during that time. Is it ok to apply for ILR now given that she still has her dependant visa valid?

Q2. The continuous stay was affected as we stayed in India for 6.5 months due to coronavirus disruptions. I understand that period of continuous stay is calculated from the date of application to previous year same date so her eligibility for the ILR is not impacted however, do I need to submit any additional documents in support of it?

When was her last PBS dependant visa issued?

Hi Zimba,

It was issued in Dec 2019 and it is valid until Dec 2022
