SET(M)

Hi All,

My husband has completed 5 year stay under spouse visa and looking to apply for ILR. Got few questions please:-

1- He completed the application online, it says the form is SET (M). Is this the correct form to submit?

2- My husband submitted B1 English from SELT Hammersmith centre with the last spouse extension. I understand it is ok to use the same certificate even though it has expired (it is over 2 years now). Do I need to include a note to the case worker to highlight that it is valid for the application so it is not overlooked or no need for that?

3- We can meet the financial requirement using 6 months cash savings or through my employment. Which route is better to take?

4- The supporting docs he got from the online form are these, is there anything missing or need to be aware of?
* Applicant and partner passports
*6 months bank statement and payslips
*6 cohabitation letters
*Council tax
*Mortgage agreement
*English certificate
*Life in the UK test

Not really necessary to do that, the CWs mostly know the rules however if it makes you more comfortable you may include the note.

3- We can meet the financial requirement using 6 months cash savings or through my employment. Which route is better to take? There is no pitfall in either one though the cash saving may be less paperwork

4- The supporting docs he got from the online form are these, is there anything missing or need to be aware of?

*Mortgage agreement
*English certificate
*Life in the UK test

Thanks AmazonianX, it turns out my husband will need to go through my employment route for this application rather than cash savings.

I have a quick question please since I had a pay rise in April 2022, would the below employment letter be good or need to add/ amend anything?

I can confirm that Mr xxx works for XXX Ltd at the above address. His date of employment commenced was March 1st 2017 and he is employed on a permanent contract. 
He is employed in the role of XXX and has a remuneration package of £55,456 (base salary) + OTE commission. This is an increase of 9% over his previous base salary of £50,415. The increase has been applied starting from April 2022.

Also, on the application, do i use the previous base or new base to fill out the form?

Seems the salary is more that enough before April and currently. Use your current wages, no flags raised.

Dec 20 (2 separate name bank statements, one under my name another under my husband)
Aug 20 Joint Electricity

Correspondence required is to cover last 2 years and what you got up there appears more than sufficient. Of you have other source to replace one of the Council tax good. If not you should still be OK.

Thanks AmazonianX, really appreciate your help. It says 2.5 years period for cohabitation on the application document checklist rather than 2, that's why I included these docs.

Can I ask if a a mobile bill and letter from "Target" confirming direct debit (Target is the company that manages help to buy direct debit) would be considered as official? I can include them instead of some of the docs to have more sources.

So if the ones you mentioned above are what you have got then Yes you can.

Thanks all again for your help so far. We are planning to submit the supporting documents before the biometric appointment, can I check please on the below points

1- The cohabitation docs needs to be distributed evenly every six months or the gap should be less (3-4 months). I am slightly confused because if it is 3-4 months it adds up to more than 6 joint docs?

2- My last payslip is dated 28th June 2022 and submitted application date is 23rd July 2020. Is this OK? My understanding is that the last payslip and bank statement needs to be dated 28 days before the application date rather than the upload/ biometric appointment, is this correct?

3- For the evidence of partner settled status in the UK, should I just submit my British Passport, would this suffice or need a different evidence?

Just submit your last 6 months payslip. You can't submit what you don't have. Since you probably have your July payslip now, you can make it 7 payslips. Nothing wrong with that. If that would make you rest easy. They'd pick what they want.

We have submitted the application on 23rd July. I am uploading the supporting documents
