Category clarification for child ILR application

Dear all,

I am trying to fill an ILR application for my 5-month-old child but got stuck on the below question and was looking for your kind help please:

In which category are you applying for indefinite leave to remain?
  • Tier 1 or Global Talent dependants

  • Tier 1 migrant

  • Skilled Worker, Tier 2 or International Sportsperson dependant

  • Skilled Worker, Tier 2 or International Sportsperson

  • Bereaved partner

  • Representative of an overseas business

  • Retired person of independent means

  • UK ancestry

  • Global talent

  • Hong Kong British National (Overseas) (BN(O))

  • Any other employment

  • Afghan Resettlement

  • Other purposes or reasons not covered by other application forms


Iformation about our situation:

The baby was born outside the UK.

The baby is currently on a dependent visa(under the mother's previous Tier-2 general skilled worker visa).

The mother recently got her ILR.

Now, both parents are ILR holders.

The plan is to apply for the baby's ILR by keeping the mother as the sponsorer.

By selecting your recommended option i.e. Skilled Worker, Tier 2 or International Sportsperson dependant, the follow-up questions about the person (on whom the baby is dependent) are being asked. One of the questions- "Which visa is Miss **** applying for or been granted?" and the options to select the answer don't show what we are looking for i.e ILR as that person is on ILR now and not on a skilled visa anymore. So, as this is a child application, can we select the last option instead(Other purposes or reasons not covered by other application forms)?

I know it gets confusing. But you stick to what the dependency the baby had from the beginning. Not what the parent has moved to now.

Same reason why you're you using SET M.

So "yes" stick with the Skilled worker.

Many thanks for your reply, that makes absolute sense. With this statement "Same reason why you're you using SET M." did you mean 'not' using? I am using Set-O of this one.

The child's ILR is based on the parent's previous status as a Tier 2 migrant. You must answer accordingly. Do not look for ILR option on the form then :!:

Sorry typo, I meant same reason you're not using set M.
