Hi,

My wife first came to UK as a Tier 4 Student dependant in Feb 2012 and till August 2019 she was a Tier 2 dependant, then from Nov 2019 - till now she is ILR dependant. But between Dec 2016-Feb 2019 she was in India for personal reasons missing the 5 years continuous route for ILR. In Gov.uk website, there is a mention about ILR 2 years continuous route for family visas applied before July 2012, but there is no further details that i could find.

Also, our daughter was born in December 2012 in India and back in Feb 2013 and was in Tier 2 dependant and ILR dependant visa since then.

Kindly advise me on further visa application, whether i should be applying them ILR on 2 years continuous route or further ILR Dependants extension.

Thank you

She needs 5 years on her current visa route to qualify for ILR, same for your daughter.

There is no shorter route available.

Just to add to the advice given to you above, note that the 5 years residence requirement does not apply to children. Children settle when both parents settle
