Dear Moderators

Currently our ILR application is pending.
In the meanwhile we had UKVI audit and then employer license has been suspended requesting further documents and he is working towards it .My current Tier 2 visa has already expired.
I would like to know the my availbale options in case the sponsor license is revoked.

1)Can i apply for a tier 2 skilled woker visa as i still have 6 more months to complete my 6 year period now or do i have to wait for the outcome of my current application from UK VI before i make any other application.

2)In stead of varying the application can my wife apply for Tier 2 skilled worker visa for 3 more years and then we can apply for ILR under 10 year route.

3)Can my wife apply for Tier 2 skilled worker visa now or should she also wait for the outcomer of her dependent application as we had applied jointly.

Any responses would be very helpful.

What do you mean by that?

I understand you already applied for the ILR. Is that correct?

Then why do you want to apply for something else? Wait for the outcome of your ILR. You don't care about what happens to your employer.

Your Tier-2 was valid when you applied for the ILR and the license of the employer was valid as well. If the sponsor's license is under audit or was suspended, that won't affect your ILR application unless they find out that your visa was obtained fraudulently.

My understanding was if his license is revoked then I will not be granted my ILR as both are interlinked.

I will be very happy if that’s not the case.

After I read thru the forum I could see that in case if revocation of sponsor license my ILR application will be refused.

Hence would like to know whether my wife can ask her employer to sponsor her.

Any response will be highly appreciated.

Your wife can. Take note not all employers have sponsorship licence.

Once my ILR is refused ,is it possible for me to apply for a skilled worker visa through another sponsor as it does no have 6 year limitation period.

You will need to secure an employer who sponsors and once there is total 5years on SWV you can get ILR.
Why do you feel your current application will fail due to the suspension of Sponsors licence by HO?
