Skilled Worker ILR Application with 3 Dependents

Hi everyone, sorry if this has been asked multiple times but need some guidance.

Skilled worker visa from Sep 2018 - Aug 2023, so I am applying soon.

1) Me (main applicant) Skilled worker Visa - 5 Year Route.
2) Wife, dependent on same skilled worker Visa (she completes 5 Year with me)
3) Child 1, dependent on same skilled worker Visa (completed 5 year with me) - UK Born on previous visa
4) Child 2, dependent on same skilled worker Visa (CANNOT complete 5 year with me as born in 2020)

Question 1) Are we all going to be on the same SET(o) application? I was a bit concerned about Child 2, given that they have not yet completed 5 years, but HO guidance say that when both parents applying ILR, the child can apply too? Please guide.

A lot of solicitors have told me different versions, some say not to apply ILR for last child, some say apply. Please help.

Also, I changed my employer once in last 5 years. Can anyone please confirm if i would need absence letter from employer? (they're a non-cooperative)

Employment 1 --> Sep 2018 - Jan 2022
Employment 2 --> March 22 - To-date

Thanks

You do NOT need to apply for ILR for a UK born child. Once you have ILR, you can apply directly to register the child as British on form MN1.
4) Child 2, dependent on same skilled worker Visa (CANNOT complete 5 year with me as born in 2020)
Where was the child born? UK or abroad?

There is no minimum 5 years for children. But if both your children were born in the UK, they do NOT need ILR.

Incorrect advice.

You only need a letter from your current employer.
