Dear All,
I'm looking or some advice based on below situation.

Currently, we (me, my wife and our 4 children) have applied FLR 10 years route (apply on Sept 2022 and this is our 2nd FLR visa) and we are still waiting for the decision from the Home Office (HO). We have been in the UK more than 10 years (since Apr 2013) continuously.

As HO are still processing our applications, we are planning to apply for ILR for 3 of our children first (as they are below 18 years old). We need some advice on how we can do the ILR applications.

My question are:
1) We need a confirmation of the form for the ILR application. Is SET LR the correct form?
2) Our FLR application only have one unique application number for 6 applicants, can my children apply for ILR separately? The reason why me, my wife and my oldest daughter cannot apply ILR together is because we are unable to take the English Test and UK Life Test as our passports are with the HO and we cannot prove our identity without it.
3) If my children apply ILR separately, will this have an impact to mine and my wife FLR application?

Form SET(LR) is used to apply under long residence. Please note that under this route each person must apply on their own and qualify on their own. So each person applies separately on their own (even kids) and there is no concept of dependent in that application.

However, simply staying/living in the UK does not make you qualify. Do you all have 10 years of lawful and continuous residence in the UK? This lawful requirement is very important.

What is your immigration history? Can you share all your visa dates and all application dates in the last 10 years?

Also how old are the kids and were they born in the UK or outside the UK ? They may qualify for ILR under the fairly new private life route

Yes, our 10 years in the UK are lawful. We are entered the UK on 25/04/2013. Here are our immigration history:

1) Visa : Tier 4, Submit Date : 04/04/2013, Granted on: 11/04/2013 - 30/08/2016
2) Tier 4, 19/08/2016, 18/09/2016 - 05/07/2017
3) Tier 4, 05/07/2017, 22/08/2017 - 30/11/2018
4) Tier 4, 28/11/2018, 12/12/2018 - 30/11/2019
5) FLR 10 years route (Family & Private Life), 28/11/2019, 17/01/2020 - 16/07/2022
6) Fee waiver, 13/07/2022 & granted on 14/09/2022
7) FLR 10 years route, submitted on 26/09/2022 & still waiting for decision.

All my kids are born outside the UK. My kids are 19yo, 17yo, 13yo and 11yo.

And as my previous message, I want to apply ILR for my kids who are below 18yo (3 kids).

It seems you applied for your FLR application within 10 working days after the fee waiver being granted, so you should benefit from section 3C. Each one of you can apply separately for ILR using form SET(LR). This will be a variation of the application from FLR to SET(LR)

If one of our family members applies ILR using form SET (LR), what happen to FLR applications of other family members (5 applicants)? still on-going?

Actually, our FLR applications is under 1 or same UAN number.

Nothing happens. That application can still go ahead and UKVI will exclude the ones who applied for other applications

* I am the applicant aged under 18 OR
* I am the parent or legal guardian of the applicant who is aged under 18 and completing and submitting the form on their behalf

What the best answer for this?

If I am answering "I am the parent or legal guardian of the applicant who is aged under 18 and completing and submitting the form on their behalf", most questions afer that are related to me as a third party. But the last question is asking about prove of financial circumstances. I am a bit confuse as this question is still asking about me or my son.

I am sure I can prove my financial myself. But if it is for my child, he is relying on me to prove his financial circumstances. Which answer should I put?

If your are the one filling on his behalf then clearly its the second option.
Still your dependant and hence any financial will be provided by parent or guardian to meet the requirements. CWs do know the rules.

There is no financial requirement or the need to provide evidence of it for SET(LR) applications.
