Hi everyone, I wonder if anyone could help me?

I will be staying in the UK for 10 years September 2023, and I suppose I will be able to submit an ILR (long residence route) application in August 2023. However, my current Tier 2 (general) visa will expire in October 2023 and so will my contract, as I work under a fixed-term (not permanent) contract.

I wonder if the expiry of both visa and work contract has any impact on my eligibility in ILR (LR) application? I heard people applying via the 5-year working visa route need to make sure their contract is still valid for quite a while after ILR application.

No, so far you have valid leave at time of application you retain same rights till a decision is made on your ILR.

No, so far you have valid leave at time of application you retain same rights till a decision is made on your ILR.

Most people's visa validity expire close to the time they apply for a new one or ILR.

ILR(LR) doesn't have work conditions attached to it.

I will be staying in the UK for 10 years this September and I plan to submit my ILR (route long residence) application as soon as I become eligible.

I noticed that for other IRL route, Home Office clearly states applicants can apply up to 28 days before. For example, in the case of 5-year Skilled Worker/Tier 2 visa route:

"The earliest you can apply is 28 days before you’ve been in the UK for 5 years on a qualifying visa."

For the 10-year long residence route, the description seems to indicate application must be submitted after the 10-year stay:

"You can submit your application as soon as you meet all the eligibility requirements - you do not need to wait until your current visa expires."

But in the Long Residence guidance document (v18.0, published on 13 Apr 2023), page 13, it states

"You can grant an application if it is considered 28 days or less before the applicant completes the required qualifying period, provided they meet all the other rules for long residence."

So I am quite confused -- would it be possible to submit ILR (set LR) application 28 days before I stay for exactly 10 years? i.e. I should apply in September after I have been in the UK for 10 years, or August which is 28 days before the September date?

Yes.

This just means you don't have to wait for your current visa to expire if you've been here for 10 years already, but can apply for SET(LR) as soon as its 28 days before 10 years.

Hello everyone

I am currently on a fixed-term contract which ends in October this year. I plan to resign and terminate my contract by just a few days because I applied for a programme that strictly starts a few days before my last day. My notice period is 3 months so I have to resign this month.

In the meantime, I will be eligible to apply for ILR under the 10-year long residence in mid August this year, hopefully with super priority if the option is available then.

I wonder if anyone knows when does HR inform Home Office, immediately after I submit my resignation, or after my last day? If HR informs Home Office immediately after my resignation, will this have any impact on my ILR application? My ILR application will be about 1.5 months before my last day, either before or after resignation.

Thanks for pointing this out! Yes I am aware of this policy. The programme is a short-term training programme that aligns with my experience and interests, so I thought I may be able to attend it if I am able to obtain ILR in time (and if super priority is available then).

My understanding was that this can only be done if they are still employed by their sponsor, which the OP will not be.

I think it is part of the conditions of stay under this visa, so I do not think you need to be employed or else this would have been implied

I recently submitted my ILR application online. I used my passport stamps as departure and arrival dates for my past trips from/to the UK in the online application form. However, I later discovered that a few departure dates were incorrect due to time zone differences.

E.g. I left UK on 01 Jan, but the passport stamp was 02 Jan as the destination's local time was ahead of UK time.

Approx. 4-5 departure dates were incorrect. Overall I was only absent for a total of ~160 days.

I wonder if the incorrect departure dates will impact my ILR application?

I haven't attended UKVCAS appointment yet -- I plan to include a cover letter, a summary table of all my departure/re-entry dates, and my booking confirmation/tickets for my trips. I hope these are sufficient and I don't need to withdraw my application?

The HO holds your records and it should not impact your application negatively. For your peace of mind you may include a cover letter to address it but not enough to withdraw the application.

The UKVI does not care about your passport stamps. The departure and arrival date are all based on UK time

The UKVI does not care about your passport stamps. The departure and arrival date are all based on UK time
