Currently have a spouse visa (extended 2 years back). The BRP expiry is end of October 2023, can I apply prior to expiry date, e.g. get application submitted 2 days before BRP.

Do the biometrics have to be done prior to RRP expiry or can they be done even after BRP expiry as long as application submitted?

Date of application is the date you submit and pay online and must be done before visa expiry.

Biometrics can be done at any time even if the visa has expired.

No! Biometrics is ONLY for identity check and finger prints and photo. They are done by a third party agent, not UKVI. The date of application is the date you submit and pay for the application online. That is it.

Last two years, from 3 to 6 different sources, spread evenly for every 3 to 4 months.

If the supporting documents are uploaded after BRP expiry is this ok as long as application is completed?

I have read the application is not sent for processing until supporting documents are done so if BRP expired by this point is that the issue?

The Supreme Court confirmed that a Biometrics appointment may be after expiry of leave. But the application date should be in-time to trigger Section 3C.

What about supporting documents upload on UKVCAS, is that ok AFTER BRP expiry?

The date of BRP expiry is not relevant at all as section 3C applies, so your leave is automatically extended

I have a diff question, do we have to provide pictures to prove relationship for ILR? We have done this previously for initial spouse visa and renewal.

No such requirement exists

Is the time frame for ILR moving to 8 years from previous 5?

Also can biometrics be done after visa expiry date on BRP?

The 8 years is just a proposal by the New Conservatives group of MPs as part of their proposals to clamp down on immigration.

No. There has never been ANY official home office or proposed government policy to change the ILR qualifying period.
The panic seems to have originated from a political pressure group conference: general-uk-immigration-forum/ilr-change ... l#p2120794

The date of application is the date you submit it online. If you apply for a new application before visa expiry, you get section 3C protection. This means your visa gets extended automatically after its expiry date until you get a decision. The Biometrics date does not affect anything and does not matter. This was already explained to you above

The group is called “New Conservatives”. As said there’s no government proposal to change current requirements.

My spouse has lived in UK for over 5 years but is the question aimed at her previous country of birth or does it include friends and social groups in UK too?

Passed B1 IELTS life skills speaking and listening in 08/2020. Used this for spouse extension visa.
The certificate says CEFR level - B1

Can it also be used for indefinite leave to remain application or is a new one needed now it has been 3 years?
