Dear friends
You all are doing a fantastic job.
I am in the process of applying for my spouse ILR application. Spouse immigration history outlined below.
Initial visa granted 04/10/2018
Spouse arrived in UK 27/10/2018
Extension Granted 07/08/2021
Expiry Current Visa 03/03/2024
Out of UK between 23/06/3023 To 24/07/2023
I would be thankful if some experienced people answer the following questions.
What is the earliest date spouse ILR application can be submitted?
I used ILR application calculator from google which advised that ILR application can be submitted from 04/09/2023 because arrival date 27/10/2018 does not count as per 180 days absence rule. This means her 5 years period start from 04/10/2018. Is this correct?
Earliest date spouse application can be submitted 28 days before 5 years qualifying period complication. Is this correct?
Any changes to evidence of residence documents? Or we only have to provide 6 joint documents for 2 years with 3 different source?
Please note I am a British citizen and my wife is on 5 years dependant spouse married visa route.
Looking forward to hear from you.
Thank you
Regards
Tj

Apply within 28 days before the 5th anniversary of the date she ENTERED the UK. Her ILR qualifying period starts on the date she entered the UK and NOT the date her initial visa was issued/granted.

There NO 180 day absence rule for spouse visa holders. Her qualifying period starts from the date she entered the UK. It is completely different dependent visa category that has the 180 day absence limit and where the qualifying period starts from visa issue date.

Yes
Any changes to evidence of residence documents? Or we only have to provide 6 joint documents for 2 years with 3 different source?
Same as for the FLR(M) extension, last two years evidence in both names from 3 to 6 different sources.

Dear Members
Thank you for the quick response.
I am confused regarding the date my wife will be qualified for ILR. As HO announced changes in the visa fee from 04/10/2023, I would appreciate if experienced members advised me the exact date my wife’s ILR application can be submitted within 28 days rule?
I am planning to submit the application either on 29/09/2023 or 30/09/2023. Would these date are ok? Please advise the date please.
Secondly, application checklist mentioned to submit 2.5 years of residence evidence not 2 years. Can experienced members clarify how many years of evidence are require? Please provide HO guidance relating to this.
You help would be appreciated.
Thank you
Regards

Dear zimba
Thank you again for a quick response.
I would really appreciate if you look into my wife visa history mentioned previously and advised me the date please. I am not good in calculating the period -28 days rule.
Please also confirm evidence require is for 2 years or 2.5 years.
I also have another question.
My employer sent me a letter confirming payslips are from them from feb 2023 to August 2023. However my September 2023 payslip is not issued yet. If I apply for ILR on 30th September then August 2023 payslip will be 30 days old from the date of application. Would this create any issue?
My monthly Bank statement runs between 2 months i.e Latest Bank statement I received covered 12 August 2023 To 12 September 2023. So I am unable to submit latest September payslip with employer stamp and bank statement to show September paid it. Would August payslip and bank statement showing August payment made would be sufficient?
Please help us.
Thank you
Regards

The exact date is 29/09/2023 for 28days concession however you can already submit right now, book appointment for after 29th September and you will still be alright.

Your most recent bank statement and payslip cannot be older than 28 days.
You can download a statement from your online banking or go into the branch with the requested date range.

Dear members
Thank you for your quick responses.
I have submitted my wife’s ILR application today 29/09/2023 at 1:00am with Super priority Service and all documents have been uploaded. However, the earliest paid appointment I got is 18/10/2023 to provide my Wife’s finger print at UKCAS.
I would appreciate if some experienced members help on the following questions.
As per HO guidance they stated that applicant may not need to provide finger print if they are applying ILR/naturalisation and HO may use finger print from previous application if were provided to UKCAS previously. My wife provided these in her previous extension. Has anyone been advised by HO regarding this?
HO timeline to decide super priority is within 1 day after enrolling finger print. My concern is that I have paid a fortune to get a quick decision but because UKCAS has no appointments before 18/10/2023. So now we have to wait till finger print enrolled. I would appreciate any suggestion on this.
Looking forward to hear from you

It is not your choice whether you can choose to use the IDV app or have to attend UKCVAS.
If you have been told through the system to book an appointment, then that is what you need to do.
If there was a choice, you would have been advised of this and told to wait 10 working days (or something like that) to be informed if she is eligible for the IDV app. Not everyone is eligible.
Also note, that Super Priority service is not a guaranteed service. The biometric appointment at UKCVAS has absolutely nothing to do with the UKVI Super Priority option service.
And to be honest, 18th October is not that far away.

Dear CR001
Thank you again for a quick response.
I would be thankful if any experienced member come across situation where HO has advised to applicant not to provide biometric because they are re-using details from previous application? This is because super priority application has been submitted.
Or HO only look application once biometric enrolled?
Looking forward to hear from you.

Your application will not proceed until you submit your biometrics. Super priority service is a visa processing service and has nothing to do with biometrics. All visa processing services become relevant AFTER you submit your biometrics
