Dear Members & Admins,
I am yet to file my ILR
1) couple of years ago i had late IT returns penalty however it got waived off
2) Couple of times council tax was not paid and i had to pay the additional fees for delay.
Do i need to declare above cases whilst filing my ILR

Dear group members/moderators
I have explained my stay in UK for 12 yrs in 2 phases below and have 9 valid questions regarding ILR 10yrs route – Answers to these may also help others in similar situation.
Phase #1
28-May-2011 - Initial Visa granted
0
1-Aug-2011 – Came to UK
0
1-Aug-2021 – Completed 10 yrs. in UK in the same visa category had multiple extensions for 10yrs
Summary of this phase #1
• Between In the above phase of 10years stayed outside UK just for 325 days and no breakage of 540days /180 days criteria.
• Had continuous lawful residence for 10 yrs.
• All the leave to remain extensions made on time
• No visa (extension) rejections nor overstay till date
• Not travelled outside UK during any visa extensions
• I have paid taxes all years via company accountant and up-to –date
• I have cleared English language test and Life in UK test.
Phase #2
15-Sep-2021 to 09-Mar-2022 – Out of UK due to personal health & family emergency for 176 days & had valid leave to remain visa whilst being outside UK
05-Apr-2022- to 26-Sep-2022 - Out of UK due to personal health & family emergency for 174 days & had valid leave to remain visa whilst being outside UK
01-Sep-2023 – Had another extension of the visa after coming back to UK
26-Sep-2022 to till date – living in UK and having valid leave to remain
Summary of this phase #2
Total days outside UK from 01-Aug-2011 to till date for
a period of 12.5 years are 675 days. Not stayed more than 180 days at any given time.
please note here that after 10 yrs i had to stay for 350 days outside UK.
Question to group members/moderators - Longs questions but very relavent /important ,thanks for reading.

1) Currently living UK having valid leave to remain, As of today is I am eligible for ILR based on the phase #1 details I mentioned above as I have built 10 yrs. of legal leave to remain between 01August 2011 to 01August 2021 as there is no breakage of 180/540 days absence + I am in UK now having valid leave to remain? The guide says I can rely on the 10yrs built in the past, even I leave /re-enter Uk apply basis of valid leave to remain being in UK .
Can you please confirm on this?
2) Do I need to count the absence from date of visa granted to date of arrival to UK between 28-May-2011 to 01-Aug-2011? Or is the 10 yrs validity stars from date of entry to UK ?
3) Do I need to provide the explanation for being outside UK in 2021/2022 for 350 days in total for any compassionate circumstances (I know they don’t exercise any) and submit the proof of documentation for being outside UK even though I am claiming the eligibility of 10 yrs between 01August 2011 to 01August 2021
4) Even though I am living in UK for 12.5 years now , how do I mention In the ILR application that I am claiming the 10 yrs between 01August 2011 to 01August 2021,do I need to provide these details in covering letter ?
5) As my long absence is post 10 yrs completion of valid leave to remain eligibility ( not to be confused with the clause - long absence towards 10yrs of completion) , will this be considered as a case of me not having intention to live in UK? do I need to substantiate anything in covering letter for this ?
6) Me currently not having valid driving license and living in hotels last 1 year will add anything to the doubt I am not having intention to live in UK if ILR is granted? I hope I don’t need toprovide any valid address proof for ILR?
7) Do I need to mention why delay in applying ILR in the covering letter being stayed for 12 years?

Having non molestation order in UK or divorce will have any impact on ILR approval? Do we need to mention this in the application covering letter?
9) What evidence I need to provide if I mention the marital status as SEPARATED in the application? Or just mentioning /selecting the option = ‘Separated’ from drop-down in the online application is good enough.

I hope the there is no impact to my question #1 based on the latest rules changed in October 2023.- If you /group members confirm on this would be a cherry on the cake.
I have one addtiional question
What is the validity of english language test ?is it 2 yrs ...One i had earlier has expired as it is more than 2 years now and have not used in any of the previous visa extensions .Do i need to get new one certificate which will be valid for next 2 years ?.Can you please clarify and help me here.

Recent rule changes do not affect you unless you have periods of temporary visa types in those 10 years. The rules simply need you to have accumulated 10 years of lawful and continuous residence in the past. An expired English language test that has never been used is not valid. Better sit a new SELT test

Hello Dear Admins/Moderators,
I have the following question regarding the postal address – ILR (LR).
Whilst applying for an ILR (LR) , I am moving between the flats and currently living in a hotel for 30 days.
In the application there is a section which asks your Postal address & the date from when you started living in that address. They have mentioned that they may use this address to send the BRP Card and for any correspondence regarding the application
My Questions relating to the above
1) Can i give my current hotel address as my postal address as i am receiving the other posts here
2) Can i give my Solicitors office address as the postal address, additionally explaining my house movement in covering letter ? Can they send the BRP to solictors office as he is representing my case.
3) If in case ,any additional correspondence required will they do with the applicant or with the solicitor who is representing the case ?
4) Can i give my friends address as C/O address.
5) I did a sample application where i mentioned hotel address & gave start date as 01/2024 ,the application dint ask any proof etc .Is there any need to show the minimum stay period in the given address etc .

English Language Test
Currently I am submitting the ILR (LR) application .I have a degree equivalent to a UK Bachelor’s degree which was thought in English and also I have English language test passed in Trinity College.
For ease of use - I would like to use the reference of English language test passed in Trinity College and I have the certificate. Hence I will be saying NO to the question “Do you have a degree equivalent to a UK Bachelors degree which was thought in English” so that in the next page I get an option to use reference of English language test passed in UK.
When I made my first VISA application to UK I have declared that my education is degree thought in English based on which points (PBS) was calculated for VISA eligibility considerations.
My question is
If I say NO to the following question – “Do you have a degree equivalent to a UK Bachelors degree which was thought in English” even though the actual answer is YES to this question,will I not be declaring something FALSE as there is a dedicated Declaration section at the end for us to agree.
Request the knowledgeable moderators to guide me on the above .

I have the following question regarding the employment section of ILR (LR) application
1) Annual Earning – gross salary varies every year based on the tax code, can I mention the gross earning numbers as per the previous P60.
2) Job Title - This should be as per the current designation or this should match as per the previous live to remain application.In my earlier visa extension application company mentioned the designation as per the job market list provided by gov.uk.
3) When did you start working for this company – I am an EXPAT ,so do I need to mention start date with this company in USA (15 years) or start date of my work in UK post deputation (10 Years) ? i was deputed to UK after 5 years of my work with company in USA.
4) Telephone number – Can I give specific HR number so that any calls gets answered as General number answered by reception? i have seen some rejections in the board as there was no response to home office calls.

What of the numbers on the company headed paper?? If you have got one that will definitely be answered. Note that not all employers are called upon

Dear moderators/CR001/Zimba
In context to the below summary ,have an important question to ask .It would be nice if you can reply at the earliest on this as there is an urgency.
In the application section there is a section where you need to mention all the dates you being outside UK
-Since you started living in the UK have you spent time outside the UK?
When you consider qualifying period of 10 yrs built in the past ,In this section do you need to mention all the dates (say 14 yrs of entry /exit if you resided) or only entry /exit dates for the qualifying period of 10 years?
For sake of giving complete information I can provide all absences for 14 yrs in the cover letter and specifically explain why i am relaying on 10 yrs qualifying period /specific 10 years and can highlight why in the application i have mentioned absence dates (entry/exit) only for those 10 years.
Is above is right way ?

But my specific question is i am claiming qualifying period between 2011 & 2021 (10Yrs) and after 2021 & till date i have long absences hence in the application under the section where you nee to mention entry/exit dates to define total days outside UK - I will give only dates between 2011 & 2021
For the sake of giving complete infortmation (which home office expects) - In the covering letter again I will mention my claim depending on the 10 yrs history built in the past between 2011 & 2021 and also explain why I am not depending /claiming the ILR for last 10 years i.e 2014 to 2024(from the date of application) as I have long absences due to covid from 2021 to 2024.
My Questions are
1. Should I mention the entry /exit dates only between 2011 & 2021 under the section Since you started living in the UK have you spent time outside the UK? For the 10 years qualifying period (I will quote case worker guide for LR ,Section and page number etc )
2.If I mention all the dates between 2011 and 2024 then case worker may be confused about my claim and may consider 10 years from the date of application - I don’t want this to happen
Can you please asses/confirm me about way of representing the entry/exit dates as in my question 1 also aspect of details I am mentioning in the covering letter giving all the information.

2. They will not get confused, they follow the rules and they know the rules
A cover letter is a good idea, just explain everything and write down that you are relying on the 10-year period between 2011 and 2021 to qualify. The rest does not matter
