ILR Application for dependents NOT Eligible for ILR

My husband has a Tier 2 Work Visa (Skilled worker) which will expire in Jan 2024 and he will apply for ILR. He has stayed in the UK for 5 years.

I got a dependent status on his visa in 2021 – so I have only 3 years and hence can’t apply for ILR. Our daughter was born in 2022 in the UK and is also on my husband’s Tier 2 visa as a dependent.
Both my daughter’s and my visa will expire in Jan 2024 and we will need to apply for dependent visa again (BRP card says that it is valid only till Jan 2024).

Both my daughter and I need to apply for dependent visa – that part we are clear.

Question: Should we apply as dependents in the ILR form that my husband fills as 1 application OR should we file separate dependent visa applications? We filled all our details under a single application but were confused that some of the questions for dependents were exactly like the ILR questions (English test, etc.).

Just to avoid any confusion – my husband’s application form has space for adding dependents (see attached photo) – is this for dependents who are applying for ILR OR is it for any dependent?

No, you should NOT add your details as SET(O) applicants there as you are not applying for ILR. SET(O) is the application form for ILR :!:
Your spouse must apply on their own under SET(O).

You and your child must apply separately as skilled worker dependants, using a different form and in a separate application. You can find the links here: https://www.gov.uk/skilled-worker-visa/ ... d-children
