ILR Children

Post by priyafa » Fri Nov 24, 2023 11:07 am

Hi team,

Can you pls advice?

Husband has ILR. He got it recently in Sep 2023. He was on Tier2skilledworker visa.
Currently , Wife is on pbs dependent visa which expires in Jan 2024.
13 year old is on pbs dependent visa which expires in Jan 2024.
5 year old is on pbs dependent visa which expires in Jan 2024.
Children born outside UK.

Wife and children will complete 5 years in May 2024.
Wife is working.

From Jan to May - does wife and children has to apply for visa extension ?

As wife is working she should have valid visa for Jan to May time period ?

If children live in UK without visa for that 5 months period is this going to be an issue when apply for ILR ?

Wife and children is planning to apply ILR in May 2024.

Pease guide.

Thanks

Hi,

I have applied for dependent partner visa. I got the email from 'apply.to.visit.or.stay.in.the.uk@notifications.service.gov.uk telling the UAN number.

Previous time when I applied for dependent partner visa 3 years back I had to take BRP appointment. This time I dont see any option for that.
This looks like a new service ? I had to take pictures before filling the application online using an app in mobile. Does that means I dont have to take BRP appointment anymore?

I am bit worried . Dont know whether I have dont anything wrong .
When I submit the application, site showed I dont have to provide any evidence.

It did not say how long I have to wait. Do you know how long I have to wait for the decision email ?

Can someone please help me?

Thanks

This seems like a pretty standard auto response to your application submittal to me. Key things you need to look out for are the UKVI logo and case id.

Thanks for helping.

They are asking IHS total 3120.00 (GBP) which is for 5 years.

I only require for 6 more months to be frank. I will be completing 5 years in UK on May 2024.
And plan is to apply for ILR in May 2024.

Are you saying even if I require it for less than 1 year I have to pay for atleast 3 years when I apply for PBS dependent ?

Unfortunately, you don't get to choose how many months you want to pay for. It's either all in or all out.

Not really. It is not mandatory to apply for ilr at exactly 5 years. Ilr is an applicants choice

Hi,

Can you please help with one more question?

I can see an option for me to upload document on the account I created to submit application.

Do they consider if I write a cover letter in there?

Explaining the situation - I am ok to pay 3 years IHS which is £1872 ( 624 * 3 ).
UKVI is asking me for 5 years amount which is £3120.

If you think they will consider then can you pls guide me to write a letter please ?

Many Thanks

Can you please check below content and tell me it is ok? Is it ok to ask like that. am not sure ..

Dear sir,

I have submitted pbs dependent application and got an email for IHS top up payment of £2184 (3120 - 936) (IHS for 5 years).

I will complete 5 years living in UK next year 2024 and thinking of applying ILR next year.
Can you please consider the situation and make the IHS payment for 3 years rather than 5 years?

Thanks

After ILR is approved is there any chance I get a partial refund ?

Thanks for the response. I dont know what to believe. When I called to the contact number in the email the person who picked up said I will get partial refund even if I give 5 years IHS.

This is so disappointing. I have to pay around £4500 for each application for extension.

We used same COS to apply visa in 2021 March and we were given visa only till 2024 Jan which means less than 3 years.
Now , when I apply in Nov 2023 am asked for 5 years IHS and application fee.
If they have given visa for atleast 4 more months initially we would not come into this situation.
We are family of 5 and its a lot of money for visa extension.

I cant do anything else jst sending post here ? This makes our life in so much trouble.

Thanks again for all the support given.

People on the other end of the line are contractors, not UKVI workers. There have been cases on this forum when incorrect advice was given by call center agents.
