Hello,
I have a question about my husbands ILR application. He came into UK on spouse visa in january 2014. In 2016 we applied for his extension but he was put on 10 year route due to financial requirement not being met. 30mths later did extension, again 10 year route, further 30mths again 10 year route (tried switching back to 5 year) but it was accepted. Anyway now we in 2024. From 2024 to 2024 10 years legal stay. Does he qualify for ILR? Even tho first 2.5 years was under 5 years but were put on 10 year in 2016. Please explain. So much confusion on the gov.uk website. Some articles makes us think he qualifies for ILR but some makes us feel he has to complete 10 years yet. I'd appreciate any advice. Thank u
Also, current brp expires March 2024

If he has continuous 10 years of legal stay, he can apply via SET(LR), via long residence, not via 10 years of family route.

Thank you for your reply.
So does the first 2.5 years don't count towards the 10 year for him to apply under family route?
I guess ilr LR is good too as he had legal continuous stay in UK without any breaks.

ILR LR has minimum of requirements to apply.

As 10 legal years without breaks have been achieved. We are going to go for Settlement Long residence.

Apart from temporary admission or short term visas, ALL other visa types count under the long residence.

That's perfect so we fit under that category. I started a dummy application to see what kind of qsts are asked in SET LR. These qsts make more sense and relatable to our situation. Thank you
