Set (M) eligibility 2 yr or 5 yr route

Hi,

I hope you all are well.

I wanted to clear a confusion on when I could potentially apply for an ILR. I have been living in the UK since 2017 on the following visas:

- PBS dependant Leave to Enter from 02/08/2017 - 02/07/2019
- PBS dependant Leave to Remain from 09/08/2019 - 01/02/2022
- Spouse / Partner Leave to Remain from 08/02/2022 - 07/08/2024

My confusion is whether I need to apply for an extension or apply for an ILR since I have been on the Spouse / Partner Leave to Remain visa only for 2 years.

My assumption is that since I have been granted 30 months limited leave from 08/02/2022 and I have already spent 60 months in the UK, hence I am eligible to apply for ILR by submitting Set (M) form.

Please confirm my understanding.

You switching to spouse visa in 2022 reset your clock to 0.
You need to complete 5yrs on spouse route to apply ILR via SET M.

How did your spouse get ILR ? What was their visa route?

My spouse’s ILR route was by completing 5 years on Tier 2 general visa. He is now a British citizen.
