ILR : multiple visas

Hi,

I am looking for some guidance on ILR.

My wife came to UK in Feb 2018 on Tier 2 ICT ( this visa does not count towards the ILR) and i and my daughter (minor) followed her in May 2018 on Tier 2 ICT dependant visa.

In Nov 2019, i got sponsorship from my employer and I chnaged my VISA to Tier 2 (General) Migrant visa, my wife and daughter joined me as Tier 2 (General) dependant Partner and Child in Nov 2019. This Visa count towards days spent in UK for the consideration of ILR. So the clock started on 13.11.2019

Later on, my wife applied for Skilled worker visa in April 2021 as her employer agreed to sponsor her visa. My daughter remained as a dependant on my Tier 2 Visa. No change to my visa or my daughter's visa at this time.

In December 2022, I and my daughter moved as a dependant to my wife's skilled worker visa. So i am now in UK on a Skilled Worker Dependant Partner (Leave to remain) and my daughter is on Skilled Worker Dependant Child (Leave to remain)

In Nov 2024, we will be completing 5 years either on Tier 2 General or Skilled Worker Visas both of which count towards ILR. As we have switched visas, and both of us became dependant to each other at some point during this period so i want to clarify if this cause any issue towards the requirement of 5 years continuous stay in UK?

We have never been outside of UK for more than 180 days in any 12 months during this period.

Time spent under the main skilled worker and dependant routes cannot be combined for ILR. You can settle after 5 years as a dependant of your spouse and settle afterwards. Your child follows your immigration path. Your wife becomes eligible in March 2026 and you will become eligible for ILR near the end of 2027

Thank you for responding to my query.

i understand that i will have to wait until end of 2027.

can my daughter apply for ILR together with my wife in March 2026? If she can't and have to wait till end of 2027 then by then she will be 19 years. Does that change anything?

No she cannot. She can only apply for ILR when you do. Children follow the same path as the less privileged parent in terms of immigration.
If she can't and have to wait till end of 2027 then by then she will be 19 years. Does that change anything?
Makes not difference provide she is not leading an independent life.
