Question on ILR application decision process

Hey Everyone,

I am on my Tier 2 General Dependent visa, on the path to apply for an ILR soon. Unfortunately I recently received IN10 (6points) on my license that had me worried about the chances of its impact on my ILR application until I noticed this post. - indefinite-leave-to-remain/ilr-applicat ... 14133.html


Now its reassuring that there is no rule to reject application based on driving license points, I wonder how ILR decisions are made,

- Is it just one decision for all members of an application/family (Main applicant & dependents) ?
- Will ILR refusal of a dependent impact the decision of main applicant ?

Could someone please clarify?

Each application is decided separately on its own merits but note that the dependent's ILR depends on you, so if you fail to qualify for ILR they cannot qualify for ILR either

Thanks for your reply.

Do you mean the dependent's ILR is dependent on the main applicant's ILR approval and not to worry if the refusal is for the dependent as it wont impact the main applicant?

No, each applicant is decided on its own and approved or refused. If the Main visa holder is refused, all dependents are also refused. If the main is approved, a dependent can still be refused if they do not meet the requirements. A dependent cannot however, be approved if the main applicant is refused. That is the point the other member was trying to convey.
