Hello Friends,

I am seeking your guidance in relation to ILR.

Your visa history would be helpful.

You previously posted you are on tiet 2 / skilled worker visa applying for ilr.

Or are you again asking on behalf of someone else???

Thanks for the response, yes it’s for a friend.

He had ILR before the marriage itself, so his wife came on spouse visa and now it’s been 5 years, just want to make sure can they apply now?

Kindly guide.

By looking at the original decision letter and the relevant paragraph of the immigration rule, often quoted in such letter.

Thanks Zimba for the response, the issue is they don’t have the original decision letter.

No, you can apply for ILR after 60 months if you are granted leave under specific rules if you satisfied the financial requirement when you initially applied and also in every subsequent exteion. If they did, then they can assume they are under the 5-year route. Otherwise, the rules will put you under the 10-year route
